An arrest warrant has been issued for a 22-year-old Albuquerque man accused of raping a 13-year-old girl from Las Vegas.


Noe A. Gilmour-Gallegos, who was 21 at the time of the rape, is charged with one count criminal sexual penetration of a child, and one count criminal sexual contact of a minor using force or coercion.

The investigation began at the end of last year when the 13-year-old girl told a New Mexico State Police officer that Gilmour-Gallegos penetrated her with his fingers, according to an arrest warrant affidavit filed in San Miguel Magistrate Court on Aug. 5.

The girl told police Gilmour-Gallegos told her not to tell anyone what had happened or he would “f--- her up,” according to the affidavit.

The girl had been staying with an older friend who was a relative of Gilmour-Gallegos. The older girl told police she’d been asleep and hadn’t seen anything, but said Gilmour-Gallegos had also “touched” her when she was younger, according to the affidavit.

Both girls notified the older girl’s father of what happened. The man told police Gilmour-Gallegos apologized to him for what happened via text message.

After obtaining search warrants for cellphones belonging to Gilmour-Gallegos and the 13-year-old girl, police located text messages and Snapchat conversations between the two.

Police say those messages show Gilmour-Gallegos wanted to be with the girl sexually, that he was attempting to coerce her into a relationship, and that he was aware the girl was 13 but still wanted to have a sexual relationship with her — at one point saying “nobody will find out,” according to the affidavit.

State Police investigators questioned Gilmour-Gallegos during a March 26 interview. During that interview, investigators allege Gilmour-Gallegos admitted to flirting with the girl on Snapchat, that he knew she was 13 and that he’d penetrated her with his fingers.

Records from San Miguel Magistrate Court indicate that the felony charges were filed against Gilmour-Gallegos on Dec. 27, 2020, the night the rape took place. However, according to the affidavit, the rape was not reported to police until Dec. 31, 2020.

Furthermore, a criminal complaint — the formal document that sets out the legal reasons it’s believed a crime was committed — was filed Aug. 5 in San Miguel Magistrate Court, months after the girl first reported the rape to police. A warrant for the arrest of Gilmour-Gallegos also wasn’t filed until Aug. 5.
