Man charged with fifth DWI offense

The state police have made another DWI arrest on Mountain View Drive.
Damian J. Valdez, 25, 2401 Calle Dulce, was charged with aggravated driving while intoxicated, driving with a revoked license and having an open container of alcohol. It was his fifth DWI offense, police said.
Around 1:30 a.m. Oct. 16, state police Officer Shane Todd saw the driver of a Chevrolet truck fail to make a stop at Mountain View and East drives, reports state.
Todd tried to catch up to the suspect, who started to speed, police said. The officer caught up to the driver, identified as Valdez, at Mountain View and Grand Avenue.
When Todd approached Valdez, he immediately noticed a strong odor of alcohol on the driver, reports state. Valdez told the officer that his license had been revoked.
The officer saw an open bottle of vodka in the front seat, police said. Asked if he had anything to drink, Valdez reportedly said he had had a couple of beers.
During the nine-step-walk-and-turn test, Valdez stepped out of line and stopped, telling the officer, “I already messed up. It’s not going to work.” He refused to take a later test, saying he knew he was going to jail.
A breath test showed Valdez’s blood-alcohol level was at .18, more than two times the state’s presumed level of intoxication.
Magistrate Judge Philip Romero set Valdez’s bond at $5,000.
